Shipping Policy

1. Scope 

This Shipping Policy applies to business-to-business purchases made from EV4 LLC through the DSDevices® United States website. 

This policy applies to business customers only and does not apply to consumer purchases. 

This Shipping Policy should be read together with our Terms of Sale, Refund & Returns Policy, Website Terms of Use, Privacy Policy, and Cookie Policy.

EV4 LLC conducts business in the United States under the DSDevices® brand. 

DSDevices® is a registered trademark of EV4 Limited and is used by EV4 LLC under license and authorization. 

3. Shipping Regions 

EV4 LLC supplies Goods to business customers within the United States, subject to order acceptance, product availability, export restrictions, carrier availability, and applicable laws. 

Orders for delivery outside the United States may be redirected to EV4 Limited, the DSDevices® UK or EU websites, an authorised distributor, reseller, or another EV4 affiliate or sales channel designated by us. 

We reserve the right to refuse, cancel, or redirect any order that cannot be fulfilled through the DSDevices® United States sales channel. 

4. Fulfilment Locations 

Orders may be fulfilled and dispatched from one of our authorised United States fulfilment centres, warehouses, third-party logistics providers, or other designated fulfilment locations depending on delivery destination, product availability, and operational requirements. 

We reserve the right to fulfil orders from alternative locations where operationally necessary. 

Our registered office address should not be used as a shipping, returns, fulfilment, or warehouse address unless we expressly instruct you to do so in writing. 

5. Shipping Methods and Carriers 

Deliveries will be arranged using a suitable carrier, courier, freight provider, third-party logistics provider, or fulfilment service selected by EV4 LLC. 

We aim to use the most appropriate, reliable, and cost-effective shipping option available for the order, taking into account the delivery destination, shipment size, shipment value, product type, service availability, delivery timeframe, and operational requirements. 

For larger, bulk, palletised, reseller, distributor, or project-based orders, alternative carriers, freight forwarders, or shipping arrangements may be used. 

Carrier selection is at our discretion unless otherwise agreed in writing. 

6. Shipping Charges 

Shipping charges are calculated and displayed during checkout where available. 

For large, bulk, reseller, distributor, project-based, special-order, or non-standard shipments, shipping charges may be quoted separately or invoiced separately. 

Shipping charges are exclusive of applicable sales tax, use tax, customs duties, import charges, brokerage fees, handling fees, and similar charges unless expressly stated otherwise. 

7. Shipping Insurance 

Shipping insurance is not included as standard unless expressly stated in writing. 

Customers are responsible for requesting shipping insurance before an order is dispatched. 

If shipping insurance is required, please contact us at info@dsdevices.com before placing your order or as soon as possible after placing your order. We will provide a quotation for the applicable insurance cost where available. 

Shipping insurance may be subject to carrier availability, shipment value, destination, product type, and any terms, exclusions, or limits imposed by the carrier or insurer. 

If shipping insurance is not requested and confirmed in writing before dispatch, the shipment will be sent without additional shipping insurance. 

8. Sales Tax, Duties, and Other Charges 

Prices displayed on the DSDevices® United States website are exclusive of applicable sales tax, use tax, duties, tariffs, customs charges, and similar governmental charges unless expressly stated otherwise. 

Customers are responsible for all applicable taxes, duties, tariffs, customs charges, import charges, brokerage fees, clearance fees, and similar charges associated with the purchase, delivery, importation, use, or resale of Goods, excluding taxes based on EV4 LLC’s income. 

Sales tax may be calculated and charged during checkout where required by applicable law. 

We reserve the right to verify tax information, exemption certificates, resale certificates, and other customer-provided tax documentation. 

We reserve the right to amend invoices or recover tax, penalties, interest, and related costs arising from incorrect, incomplete, expired, or invalid information supplied by the customer. 

9. Delivery Estimates 

Delivery dates and delivery times are estimates only and are not guaranteed. 

Goods will normally be delivered within thirty (30) calendar days of Order Confirmation unless otherwise agreed, stated during checkout, or specified in the Order Confirmation. 

Delivery estimates may be affected by product availability, backorders, pre-orders, carrier delays, fulfilment delays, public holidays, supply chain disruption, weather, incorrect delivery details, failed delivery attempts, or events outside our reasonable control. 

EV4 LLC shall not be liable for delays caused by carriers, fulfilment providers, customs authorities where applicable, supply chain interruptions, customer-side delays, or events beyond our reasonable control. 

10. Backorders, Pre-Orders, and Split Shipments 

Goods may be backordered, offered on a pre-order basis, or shipped separately where stock availability, fulfilment, or operational requirements make this necessary. 

Where an order contains multiple Goods, we may dispatch items separately. 

If part of an order is delayed, we may ship available Goods first and dispatch the remaining Goods when available, unless otherwise agreed. 

Additional shipping charges may apply to split shipments where agreed with the customer or where required by the nature of the order. 

11. Delivery Address and Customer Responsibilities 

Customers are responsible for ensuring that all delivery information provided to us is complete, accurate, and suitable for carrier delivery. 

The customer is responsible for ensuring that someone is available to receive the Goods at the delivery address. 

If delivery cannot be completed because no person is available to receive the Goods, the carrier may attempt redelivery, provide collection options, or return the Goods to us or to our fulfilment provider. 

Additional charges arising from incorrect addresses, failed delivery attempts, refused deliveries, storage charges, redirection requests, or return-to-sender shipments may be charged to the customer. 

12. Reseller and Channel Partner Shipments 

Where Goods are purchased by a reseller, distributor, channel partner, systems integrator, or other intermediary for resale or supply to an end customer, the reseller or channel partner is responsible for its own shipping, delivery, fulfilment, and customer service arrangements with that end customer unless EV4 LLC has expressly agreed otherwise in writing. 

EV4 LLC is not responsible for delivery commitments, shipping charges, delivery delays, failed deliveries, customs charges, tax charges, import issues, insurance arrangements, or other fulfilment obligations agreed directly between a reseller or channel partner and its end customer. 

Resellers and channel partners are responsible for ensuring that Goods are handled, stored, packaged, labelled, shipped, and delivered in a safe, suitable, and lawful manner and in accordance with any applicable product documentation, export controls, customs requirements, tax requirements, carrier requirements, and applicable laws. 

Resellers and channel partners must not make delivery promises, shipping guarantees, warranty commitments, return commitments, service commitments, or support commitments on behalf of EV4 LLC unless expressly authorised by EV4 LLC in writing. 

Where an end customer requires support, warranty assistance, or a return relating to Goods supplied by a reseller or channel partner, the reseller or channel partner will normally act as the first point of contact unless EV4 LLC agrees otherwise in writing. Any returns, RMAs, repairs, replacements, or warranty claims remain subject to EV4 LLC’s applicable Terms of Sale, Refund & Returns Policy, warranty terms, and any separate reseller, distributor, or partner agreement. 

13. Risk and Ownership 

Ownership of the Goods shall not pass to the customer until EV4 LLC has received payment in full. 

Risk of loss or damage shall pass in accordance with the delivery, shipping, or Incoterms® rule specified on the Order Confirmation, invoice, quotation, or written agreement between the parties. 

Unless otherwise agreed in writing, risk of loss and damage passes to the customer when the Goods are delivered to the carrier, fulfilment provider, freight provider, or other shipping provider for dispatch to the customer. 

Shipping insurance is not included unless expressly requested, quoted, and confirmed in writing before dispatch. 

14. Damaged Shipments 

Customers must inspect Goods promptly upon delivery. 

If Goods arrive damaged, the customer should notify us as soon as possible and, in any event, within forty-eight (48) hours of delivery. 

Damage reports should include: 

Order Number; 

delivery date; 

tracking number, where available; 

photographs of the outer packaging; 

photographs of the damaged Goods; 

details of the damage; and 

any carrier delivery notes or damage reports. 

Customers should retain all packaging materials until the claim has been reviewed. 

Failure to report shipping damage promptly or failure to retain packaging may affect our ability to investigate the issue or make a carrier claim. 

15. Lost or Delayed Shipments 

If tracking information indicates that a shipment is significantly delayed, lost, or has not updated for an unusual period, customers should contact us at info@dsdevices.com with their Order Number and tracking details. 

We will make reasonable efforts to assist with carrier investigations. 

Carrier investigations may take time and are subject to the carrier’s own procedures. 

Refunds, replacements, or credits for lost shipments will be handled in accordance with our Terms of Sale, this Shipping Policy, and any applicable carrier investigation outcome. 

16. Refused Deliveries and Failed Delivery 

If a customer refuses delivery without our prior written approval, or if delivery fails because of incorrect delivery information, non-payment of charges, import refusal, lack of recipient availability, or failure to cooperate with the carrier, the customer may be responsible for: 

return shipping costs; 

carrier charges; 

storage charges; 

taxes, duties, tariffs, customs charges, or similar charges where applicable; 

re-delivery fees; 

administrative costs; and 

any loss in value of the Goods. 

Refunds for refused or failed deliveries are not automatic and remain subject to inspection, approval, and our applicable Terms of Sale and Refund & Returns Policy. 

17. Export Compliance 

Customers and resellers must comply with all applicable United States export control, sanctions, customs, and trade compliance laws. 

We may refuse, suspend, or cancel any order where we reasonably believe fulfilment would breach applicable export control, sanctions, customs, or trade compliance laws. 

The customer is solely responsible for obtaining any required import, export, or re-export authorisations unless otherwise agreed in writing. 

Customers must not directly or indirectly export, re-export, transfer, or provide any Goods supplied by EV4 LLC in violation of applicable export control laws, regulations, or sanctions administered by the United States Government. 

18. Returns and RMAs 

Shipping arrangements for returns, faulty Goods, warranty claims, and RMAs are governed by our Refund & Returns Policy. 

Customers must contact EV4 LLC before returning any Goods. 

Returns must not be shipped to any EV4 LLC office, registered office, warehouse, fulfilment centre, 3PL, repair centre, or other location unless EV4 LLC has issued return instructions and, where required, a valid Return Merchandise Authorization (RMA). 

Goods returned without authorisation may be refused and returned to the sender at the sender’s expense. 

Returns must be shipped only to the United States return address provided by EV4 LLC when the RMA is issued. This address may be an authorised EV4 LLC third-party logistics provider, warehouse, repair centre, service centre, or other designated returns facility. 

19. Events Outside Our Control 

We shall not be liable for shipping delays or failures caused by events outside our reasonable control, including but not limited to carrier disruption, fulfilment provider disruption, customs delays where applicable, strikes, labour disputes, natural disasters, war, terrorism, government action, supply chain disruption, telecommunications failure, internet service failure, cybersecurity incidents, or other events beyond our reasonable control. 

Where such an event affects delivery, we will take reasonable steps to minimise the delay and will inform affected customers where reasonably possible.
