Background
These Terms of Use (“Terms”) govern your access to and use of the DSDevices® website located at https://dsdevices.com/us (the “Site”), the DSD Selector App (the “App”), and any related content, tools, software, applications, documentation, downloads, features or services made available by EV4 LLC through the Site or App, collectively referred to in these Terms as the “Services”.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Services immediately.
These Terms of Use do not govern the sale of products. Product purchases are governed separately by the applicable Terms of Sale. Where the DSD Selector App is supplied with, installed on, or made available for use with DSDevices® hardware, these Terms govern your use of the App and related Services, not the sale of the hardware itself.
1. Definitions
“Account” means a registered user account used to access certain features of the Services.
“App” or “DSD Selector App” means the DSDevices® software application, tool or interface designed to assist users with CMS selection, app installation, device setup, provisioning, configuration, diagnostics, support and related functionality for DSDevices® hardware.
“CMS” means a content management system, digital signage software platform, application, service or provider used with DSDevices® hardware.
“Content” means all text, graphics, images, software, firmware, code, documentation, databases, audio, video, product information, specifications, downloads, CMS information, compatibility information, diagnostic information, app content and other materials available through the Services.
“Device Data” means technical, diagnostic, provisioning, configuration, usage, support or similar information relating to DSDevices® hardware or the DSD Selector App, which may include device identifiers, MAC address, IP address, serial number, firmware version, app version, selected CMS provider, configuration status, error reports, crash logs and diagnostic logs.
“Services” means the Site, the DSD Selector App, and any related content, tools, software, documentation, downloads, features, support tools or services made available by EV4 LLC.
“Third-Party CMS Provider” means an independent third-party provider of a CMS, application, platform, service, subscription or related software made available, referenced, linked to, selectable or accessible through the Services or the DSD Selector App.
“User” means any person accessing or using the Services.
“User Content” means content submitted by Users, including reviews, comments, feedback, support information, configuration information or other materials submitted through the Site, the App or customer support channels.
“DSDevices®” means the registered trademark of EV4 Limited.

DSDevices® is a registered trademark of EV4 Limited and is used by EV4 LLC under license and authorization.
3. Access to the Services
Access to the Site is provided free of charge.
The DSD Selector App may be supplied with, pre-installed on, made available for download to, or used in connection with DSDevices® hardware.
The Services are provided on an “AS IS” and “AS AVAILABLE” basis.
EV4 LLC may modify, suspend, discontinue, restrict, update or replace all or any part of the Services at any time without notice, including the Site, the DSD Selector App, CMS selection functionality, provisioning tools, compatibility information, diagnostic features and support tools.
We do not guarantee that the Services will always be available, uninterrupted, secure, compatible, current or error-free.
Availability and functionality of the DSD Selector App may vary depending on device model, firmware version, app version, region, network environment, CMS provider availability, CMS partner approval, third-party service availability and customer configuration.
4. Accounts
Certain portions of the Services may require an Account.
You must be at least eighteen (18) years old to create an Account.
You agree to:
Provide accurate and complete information.
Maintain and promptly update your Account information.
Maintain the confidentiality of your login credentials.
Notify us immediately of any unauthorized use of your Account.
You are responsible for all activity occurring under your Account.
Use of the DSD Selector App may also require device information, support information, CMS selection information, third-party CMS credentials, customer configuration information or other technical details.
You are responsible for maintaining the confidentiality and security of any credentials used with the Services, including credentials for your Account, DSDevices® services, third-party CMS platforms, network services and related systems.
We reserve the right to suspend or terminate any Account or restrict access to the Services at our sole discretion.
If you close your Account, certain transactional records, warranty records, support records, serial number records, device records, provisioning records and diagnostic records may be retained in accordance with our Privacy Policy and legal obligations.
5. DSD Selector App and Third-Party CMS Providers
The DSD Selector App is provided as a deployment and configuration tool designed to assist users with CMS selection, app installation, device setup, provisioning, configuration, diagnostics, support and related functionality for DSDevices® hardware.
The DSD Selector App is not itself a third-party CMS platform and does not replace the terms, privacy policy, support arrangements, licence requirements or subscription requirements of any Third-Party CMS Provider.
Third-party CMS platforms, applications, services or providers made available, referenced, selectable, linked to or accessible through the DSD Selector App are provided by independent third parties.
Your use of any third-party CMS platform may be subject to separate terms, privacy policies, licence agreements, fees, subscriptions, service levels, support arrangements and data practices imposed by the applicable Third-Party CMS Provider.
You are responsible for:
Selecting the CMS provider suitable for your intended use.
Obtaining any required CMS accounts, licences, subscriptions or permissions.
Confirming compatibility between your selected CMS, device model, firmware, network environment and intended deployment.
Ensuring that your use of any CMS platform complies with applicable laws, regulations and third-party terms.
Maintaining network access, security settings, credentials and customer-side configuration required for deployment.
EV4 LLC may list, reference, integrate with or make available certain CMS providers through the DSD Selector App. Such availability does not guarantee that a CMS provider will remain available, compatible, supported, certified, approved or suitable for your intended use.
Unless expressly stated otherwise in writing, EV4 LLC is not responsible for the operation, availability, performance, support, security, content, updates, fees, subscriptions, data practices or legal compliance of any Third-Party CMS Provider.
The DSD Selector App may process Device Data and other technical information in accordance with our Privacy Policy. Where necessary to support CMS selection, provisioning, activation, troubleshooting, app installation or device configuration, limited Device Data or configuration information may be made available to relevant service providers or Third-Party CMS Providers as described in our Privacy Policy.
6. Intellectual Property Rights
DSDevices® is a registered trademark of EV4 Limited.
All Content on or made available through the Services is owned by EV4 LLC, EV4 Limited, their affiliates, licensors, Third-Party CMS Providers or content providers and is protected by United States and international intellectual property laws.
The DSD Selector App, including its software, firmware components, code, user interface, design, documentation, configuration tools, diagnostic tools, workflows and related materials, is licensed and not sold.
Subject to your compliance with these Terms, EV4 LLC grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Services, including the DSD Selector App, solely for lawful internal business purposes and, where applicable, in connection with DSDevices® hardware.
Except as expressly permitted by these Terms, you may not:
Reproduce, copy, distribute, modify, publish, transmit, display, perform, sell, license, rent, sublicense, or otherwise exploit any Content.
Use any DSDevices® trademark, logo, trade dress, product name, or branding without prior written authorization.
Remove or alter any proprietary notices.
Copy, modify, adapt, translate, reverse engineer, decompile, disassemble or attempt to derive the source code of the DSD Selector App or any related software, except to the extent such restriction is prohibited by applicable law.
Circumvent, disable or interfere with any security, licensing, provisioning, device management, CMS selection or access-control feature of the Services.
Use the Services to develop a competing product, service, application, CMS selection tool, provisioning system or device management platform.
You may:
Access and view the Site through a web browser.
Use the DSD Selector App in accordance with these Terms, applicable documentation and intended functionality.
Print a single copy of Site pages for internal business reference.
Download publicly provided documentation intended for customer use.
All goodwill arising from the use of DSDevices® trademarks shall inure exclusively to the benefit of EV4 Limited.
7. User Content
Where permitted by the Services, Users may submit content including reviews, comments, feedback, support information, configuration details, diagnostic information or other materials.
You represent and warrant that:
You own or control all rights necessary to submit the content.
The content does not violate any law or third-party rights.
The content complies with these Terms.
You retain ownership of your User Content.
By submitting User Content, you grant EV4 LLC and its affiliates a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute, display, analyse and otherwise exploit such content in connection with the operation, support, promotion, security, diagnostics and improvement of the Services and business.
This licence includes the right to use feedback, comments, support information, diagnostic information and suggestions submitted through or in relation to the DSD Selector App to improve DSDevices® products, services, software, support tools and customer experience.
We reserve the right to remove any User Content at our sole discretion.
8. No Scraping, Data Mining, or AI Training
You may not:
Scrape, crawl, harvest, mirror, extract, index, or collect Content from the Services.
Use automated tools, bots, spiders, crawlers, scripts or similar technologies to access the Services.
Use any Site Content, App Content, technical documentation, product specifications, firmware information, software, images, CMS information, compatibility information, diagnostic information or other materials to develop, train, test, fine-tune, validate or improve any artificial intelligence, machine learning, large language model, neural network or similar system.
Create derivative datasets based upon Content from the Services.
Access, extract, copy or analyse data from the DSD Selector App, its interfaces, workflows, APIs, logs, configuration processes or CMS selection functionality except as expressly permitted by EV4 LLC.
Any unauthorized use of Content from the Services for automated collection, AI training, machine learning, competitive analysis or dataset creation purposes is expressly prohibited.
9. Links to the Site
You may link to the Site provided that:
The link is fair and lawful.
The link does not imply sponsorship, endorsement, or affiliation without authorization.
No DSDevices® trademarks or logos are used without permission.
The link does not harm the reputation of EV4 LLC or DSDevices®.
Framing, embedding, mirroring, or deep-linking to the Site requires prior written authorization.
10. Links to Third-Party Websites, Apps, and Services
The Services may contain links to, integrate with, reference, display or make available third-party websites, applications, CMS platforms, software, services or providers.
EV4 LLC does not control and is not responsible for third-party websites, content, products, services, CMS platforms, privacy practices, terms, fees, subscriptions, licences, security practices, policies, support arrangements or availability.
Links, integrations, references, listings or CMS selection options are provided for convenience and operational functionality and do not imply endorsement, guarantee or assumption of liability unless expressly stated otherwise in writing.
You should review the applicable terms and privacy policies of any Third-Party CMS Provider or other third-party service before using it.
11. Disclaimer of Warranties
THE SERVICES, INCLUDING THE SITE, THE DSD SELECTOR APP, ALL CONTENT, CMS SELECTION FUNCTIONALITY, CONFIGURATION TOOLS, DIAGNOSTIC TOOLS, COMPATIBILITY INFORMATION AND RELATED MATERIALS, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EV4 LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, COMPATIBILITY, PERFORMANCE, SECURITY, AVAILABILITY OR ERROR-FREE OPERATION.
EV4 LLC DOES NOT WARRANT THAT:
THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
DEFECTS WILL BE CORRECTED.
THE SERVICES ARE FREE OF VIRUSES OR HARMFUL COMPONENTS.
THE CONTENT IS COMPLETE, ACCURATE, OR CURRENT.
THE DSD SELECTOR APP WILL SELECT, INSTALL, CONFIGURE, PROVISION OR ACTIVATE ANY CMS PLATFORM SUCCESSFULLY IN ALL CASES.
ANY THIRD-PARTY CMS PLATFORM WILL BE AVAILABLE, COMPATIBLE, SECURE, SUITABLE, SUPPORTED, APPROVED OR ERROR-FREE.
ANY DEVICE CONFIGURATION, CMS SELECTION, COMPATIBILITY INFORMATION OR DIAGNOSTIC INFORMATION WILL BE COMPLETE, CURRENT OR SUITABLE FOR YOUR SPECIFIC DEPLOYMENT.
PRODUCT WARRANTIES ARE GOVERNED EXCLUSIVELY BY THE APPLICABLE TERMS OF SALE AND WARRANTY POLICY.
ANY WARRANTIES RELATING TO THIRD-PARTY CMS PLATFORMS, APPLICATIONS OR SERVICES ARE GOVERNED EXCLUSIVELY BY THE TERMS PROVIDED BY THE APPLICABLE THIRD-PARTY CMS PROVIDER.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EV4 LLC SHALL NOT BE LIABLE FOR:
INDIRECT DAMAGES.
INCIDENTAL DAMAGES.
SPECIAL DAMAGES.
CONSEQUENTIAL DAMAGES.
EXEMPLARY DAMAGES.
PUNITIVE DAMAGES.
LOSS OF PROFITS.
LOSS OF REVENUE.
LOSS OF DATA.
LOSS OF GOODWILL.
BUSINESS INTERRUPTION.
LOSS OF BUSINESS OPPORTUNITY.
DEVICE MISCONFIGURATION.
CMS PLATFORM UNAVAILABILITY.
THIRD-PARTY CMS FAILURES.
NETWORK, CUSTOMER CONFIGURATION OR THIRD-PARTY SERVICE ISSUES.
EV4 LLC’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES, INCLUDING THE SITE, THE DSD SELECTOR APP, CONTENT, CMS SELECTION FUNCTIONALITY, DIAGNOSTIC TOOLS, CONFIGURATION TOOLS OR THIRD-PARTY CMS REFERENCES, SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Acceptable Use
You may use the Services only for lawful purposes.
You may not:
Violate applicable laws or regulations.
Upload malicious code or malware.
Attempt unauthorized access to systems, devices, networks, CMS platforms or accounts.
Interfere with Site, App, device, CMS or service operation or security.
Impersonate another person or organization.
Submit false or misleading information.
Infringe intellectual property rights.
Harass, threaten, abuse, or harm others.
Use the DSD Selector App to access, configure, provision or interfere with devices, CMS platforms, accounts or systems that you do not own or are not authorized to manage.
Use the DSD Selector App to bypass licensing, subscriptions, activation, provisioning, device management, security controls or CMS provider restrictions.
Install, attempt to install, configure or use unauthorized, malicious, unsupported or unlawful applications through or in connection with the DSD Selector App.
Misuse support tools, diagnostics, logs, device identifiers, MAC addresses, serial numbers, CMS selection tools or configuration functionality.
We reserve the right to suspend or terminate access for violations of these Terms.
14. Security
You may not:
Introduce malware, viruses, ransomware, spyware, or other harmful code.
Attempt unauthorized access to any part of the Services or associated systems.
Attempt unauthorized access to DSDevices® hardware, customer accounts, CMS platforms, third-party services or networks.
Conduct denial-of-service attacks.
Circumvent security controls, provisioning controls, activation controls, app restrictions, device management controls or CMS access controls.
Probe, scan, test or interfere with the vulnerability or security of the Services without written authorization.
Violations may result in termination of access and referral to law enforcement authorities.
15. Technical Information Disclaimer
Technical specifications, product documentation, firmware information, compatibility information, CMS information, DSD Selector App information, reference designs, application notes, diagnostics and other technical materials are provided for informational purposes only.
Such information may be modified, updated, corrected, replaced or withdrawn without notice.
Any CMS availability, compatibility status, certification status, app listing, provisioning option, installation option or configuration guidance shown through the Site or the DSD Selector App may change at any time.
Customers are responsible for independently validating suitability, compatibility, security, regulatory compliance, network readiness, CMS suitability and fitness for their intended application before deployment.
EV4 LLC shall not be responsible for losses arising from reliance upon technical information published on or made available through the Services.
16. Privacy and Cookies
Use of the Services, including the Site and the DSD Selector App, is governed by the Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.
The DSD Selector App may collect or process Device Data, diagnostic information, configuration information, support information, app usage information and CMS selection information as described in our Privacy Policy.
Depending on the functionality used, third-party CMS platforms or service providers may also process information under their own privacy policies and terms.
17. Changes to These Terms
EV4 LLC may revise these Terms at any time.
Updated versions will be posted on the Site and become effective upon publication unless otherwise stated.
We may also provide notice of updates through the DSD Selector App, by email, through customer communications or by other reasonable means.
Continued use of the Services constitutes acceptance of revised Terms.

Security matters.
Product notices.
App notices.
Firmware or software notices.
DSD Selector App updates.
CMS selection, provisioning or configuration matters.
Support issues.
Policy updates.

Marketing communications will be sent only in accordance with applicable law and our Privacy Policy.

19. General Terms
EV4 LLC may assign its rights and obligations under these Terms.
Users may not assign rights or obligations without written consent.
If any provision is found unenforceable, the remaining provisions shall remain in effect.
No waiver of any provision shall constitute a continuing waiver.
These Terms constitute the entire agreement regarding use of the Services.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of laws principles.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply.
Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and each party irrevocably submits to the jurisdiction of those courts.
